1. Scope and Applicability
1.1 These General Terms and Conditions (“Terms”) govern the contractual relationship between Restauranthub.eu and customers (“Customers”) using the platform.
1.2 Restauranthub.eu operates as an intermediary platform facilitating the conclusion of agreements between Customers and independent merchant restaurants (“Merchant Restaurants”).
1.3 These Terms apply exclusively to the services provided by Restauranthub.eu.
The preparation, sale, and delivery of products are the sole responsibility of the Merchant Restaurant.
1.4 By placing an Order via the Platform, the Customer confirms acceptance of these Terms.

3. Definitions

Platform: All websites, applications, and digital systems operated by Restauranthub.eu.

Service: Intermediary services including listing restaurants, transmitting orders, and facilitating payments.

Customer: Any natural or legal person placing an Order through the Platform.

Merchant Restaurant: An independent business offering food or beverages via the Platform.

Offer: Products and services made available by the Merchant Restaurant.

Order: A binding order placed by the Customer via the Platform.

Agreement: The contract concluded directly between the Customer and the Merchant Restaurant.
4. Role of Restauranthub.eu
4.1 Restauranthub.eu is not a party to the Agreement between the Customer and the Merchant Restaurant.
4.2 Restauranthub.eu does not prepare food, determine prices, or manage delivery logistics unless explicitly stated.
4.3 Information displayed on the Platform originates from Merchant Restaurants. Restauranthub.eu does not guarantee its accuracy or availability.
5. Placing an Order
5.1 An Agreement is concluded when the Customer confirms the Order by activating the “Place Order” function.
5.2 The Customer will receive an electronic confirmation upon successful submission.
5.3 The Customer is responsible for providing accurate and complete contact, address, and payment details.
5.4 The Customer must remain reachable for order-related communication.
6. Delivery and Collection
6.1 For delivery Orders, the Customer must be present at the specified address at the agreed time.
6.2 For collection Orders, the Customer must collect the Order at the agreed time and location.
6.3 Delivery fees, if applicable, are displayed prior to Order confirmation.
6.4 Merchant Restaurants may request proof of age for age-restricted products. Failure to comply may result in refusal without entitlement to refund.
7. Right of Withdrawal and Cancellation
7.1 Pursuant to Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to contracts for the supply of perishable goods, including prepared food.
7.2 Orders cannot be cancelled by the Customer unless expressly permitted by the Merchant Restaurant.
7.3 Merchant Restaurants may cancel Orders due to unavailability, incorrect information, force majeure, or other justified reasons.
8. Payments and Refunds
8.1 Payment is due immediately upon conclusion of the Agreement.
8.2 Online payments are processed by Restauranthub.eu on behalf of the Merchant Restaurant.
8.3 Refunds, where applicable, shall be processed via the original payment method within a maximum of seven (7) working days.
9. Misuse and Fraud
9.1 Restauranthub.eu reserves the right to refuse Orders or restrict access in cases of misuse, fraud, or repeated non-compliance.
9.2 Suspected fraudulent activity may be reported to competent authorities.
10. Complaints Handling
10.1 Complaints regarding the Offer or execution of the Agreement must be addressed to the Merchant Restaurant.
10.2 Complaints regarding the Service may be submitted to Restauranthub.eu using the contact details provided.
10.3 Complaints will be acknowledged within seven (7) days and handled within fourteen (14) days where possible.
11. Governing Law and Jurisdiction
11.1 These Terms are governed by Belgian law, without prejudice to mandatory consumer protection provisions applicable in the Customer’s country of residence within the EU.
11.2 Disputes shall fall under the jurisdiction of the competent courts of Belgium, unless EU consumer law provides otherwise.
